EULA - End User License Agreement

END USER LICENSE AGREEMENT

IMPORTANT - Read this License Agreement carefully before installing the accompanying software ("Software"). Your use of the Software indicates your acceptance of this license agreement.

This Software is protected by copyright laws and other intellectual property laws and treaties. This Software is licensed, not sold. This Software is Copyright 2011 by Xelfera. All rights not expressly granted in this license Agreement are retained by Xelfera.

Xelfera hereby grants you a non-exclusive license to use the Software. For evaluation, the license is granted, and is time-limited. To use the Software for any purpose other than the time-limited evaluation, you have to pay a license fee and obtain a runtime license from Xelfera for a specific computer.

You may:
Use the Software with a time-limited demo license on any computer for evaluation purposes within the specified time limit.
Use the Software with a paid runtime license on a single designated computer that you are authorized to use, monitor and administer.

You may not:
Use the software for purposes other than its intended use.
Modify, translate, reverse engineer, decompile, disassemble (except to the extent applicable laws specifically prohibit such restriction).
Create derivative works based on the Software.
Copy the Software.
Rent, lease, transfer or otherwise transfer rights to the Software.
Remove any proprietary notices or labels on the Software.
Permit other individuals or entities to use the Software except under the terms listed above.

TERMINATION.
The license will terminate automatically if you fail to comply with the limitations described above. On termination, you must destroy all copies of the Software and Documentation.

LIMITATION OF LIABILITY AND NO WARRANTIES
THE SOFTWARE IS MADE AVAILABLE "AS IS" BY XELFERA. XELFERA AND THE SOFTWARE'S ORIGINAL AUTHOR(S) DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND IN NO EVENT SHALL XELFERA AND THE SOFTWARE'S AUTHOR(S) BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES WHATSOEVER, WHETHER IN AN ACTION OF CONTRACT, TORT, OR STRICT LIABILITY, ARISING OUT OF OR IN ANY CONNECTION WITH THE USE OR PERFORMANCE OF THIS SOFTWARE.
